Understanding Your Right of Way Easement


I


f you have electric cooperative lines running through your property, chances are the land beneath those lines is included in a right of way


easement. To avoid conflict or miscommunication, landowners with easements on their property should understand where the right of way is located and what the easement entails.


For Kiamichi Electric, a right of way is a strip of land used to construct, maintain and repair its power lines. The easement contract between Kiamichi Electric and a landowner is a legal restriction on land use that allows Kiamichi Electric to build, operate and maintain a power line. It also allows the landowner to retain general ownership and control of the land.

A right of way easement gives Kiamichi Electric the right to:


Survey, construct, operate, maintain, upgrade and repair a line located on the defined right of way.


• Clear and trim vegetation and trees from within the entire easement area once the line is built.


• Remove dangerous trees or limbs adjacent to the right of way in order to ensure the safe and reliable distribution of electricity.
